SECTION A: TRUCK & PLANT SALES & HIRE TERMS

1. Sales Terms

1.1. All equipment sold by GBT WIGAN LTD ("GBT") is sold as seen, with no warranties or guarantees, express or implied.​

1.2. GBT makes no representation as to the mechanical condition, mileage, hours, or suitability of the equipment unless explicitly stated in writing.​

1.3. Inspection is optional and the responsibility of the purchaser. Failure to inspect shall not form grounds for dispute or refund.​

1.4. Full payment is required in cleared funds before delivery or release of any vehicle or equipment.​

1.5. Delivery is available. Rates are discussed on a case-by-case basis and must be agreed prior to dispatch.​

2. Hire Terms

2.1. All equipment is hired on a weekly rate basis. Daily rates may be agreed in writing for short-term hires.​

2.2. Hire periods are flexible. No minimum or maximum durations apply unless specified in writing.​

2.3. The hirer is fully responsible for the equipment during the hire period, including:

  • Fuel and consumables

  • Daily maintenance and checks

  • Damage, theft, or misuse​

2.4. Equipment is supplied without operators, unless otherwise agreed.​

2.5. A signed hire agreement is required for all hires. GBT reserves the right to carry out company and credit checks before accepting any hire arrangement.​

2.6. Damage Charges: Where equipment is returned damaged or excessively worn, GBT reserves the right to charge the hirer for repairs, parts, labour, or full replacement. Charges shall be based on standard industry rates plus reasonable admin costs.​

2.7. Late Return Fees: If equipment is returned later than the agreed period, additional hire charges shall apply pro-ratabased on the agreed weekly rate plus a 10% late fee.​

3. Cancellations (Sales & Hire)

3.1. Cancellations made more than 2 business days prior to the commencement of the hire or delivery date are subject to a 25% cancellation fee of the total order value.​

3.2. Cancellations made within 2 business days prior to the commencement of the hire or delivery date are subject to a 50% cancellation fee of the total order value.​

3.3. Cancellations made after dispatch or failure to collect/honour delivery will result in the client being liable for full hire/sale cost and transport expenses.​

SECTION B: WASTE BROKERAGE TERMS

1. Scope of Service

1.1. GBT acts as a licensed waste broker, registered with the Environment Agency (Upper Tier Licence), matching clients with authorised waste carriers.​

1.2. GBT may, in some cases, invoice on behalf of carriers or issue waste collection invoices directly. The client will be advised accordingly.​

2. Service Commitment

2.1. GBT guarantees collection dates as agreed at the time of booking. While we strive to deliver on time, events beyond our control may impact service (e.g., access issues, weather, carrier delays).​

2.2. GBT is not liable for contamination charges, access failures, or incorrect waste classification unless explicitly managed by GBT.​

3. Payment Terms

3.1. All waste brokerage invoices are due upon receipt, unless agreed otherwise in writing.​

3.2. Late Payment Charges: In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, overdue invoices may incur:

  • Statutory interest at 8% above the Bank of England base rate

  • Fixed compensation fees:

    • £40 for debts up to £999.99

    • £70 for debts between £1,000 and £9,999.99

    • £100 for debts of £10,000 or more​

4. Documentation

4.1. All waste transfer notes and consignment notes are issued by the appointed carrier.​

4.2. GBT can assist in obtaining copies of documentation upon request.​

5. Cancellation & Missed Collections

5.1. Cancellations made more than 2 business days prior to the scheduled collection date are subject to a 25% cancellation fee of the total order value.​

5.2. Cancellations made within 2 business days prior to the scheduled collection date are subject to a 50% cancellation fee of the total order value.​

5.3. Where a collection cannot be completed due to client-side issues (e.g., access blocked, incorrect waste), GBT reserves the right to charge for the failed service.​

SECTION C: GENERAL TERMS

1. Legal Jurisdiction

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.​

2. Liability Limitation

2.1. GBT shall not be liable for any loss of business, profit, indirect or consequential loss resulting from sales, hire, or brokerage services.​

2.2. Liability for physical loss or damage shall be limited to the value of the goods or services directly supplied.​

3. Data Protection

3.1. All data submitted to GBT is handled in line with the UK GDPR and will not be shared with third parties unless required for service delivery.​

4. Website Use

4.1. All content, imagery, and listings on this website remain the property of GBT WIGAN LTD.​

4.2. Unauthorised copying, reproduction, or misuse of content is prohibited.​
